Terms and licenses

1. Agreement and eligibility

These terms govern paid GhostSandbox deliverables from AdamsLocal LLC ("AdamsLocal," "we," or "us"). By completing a purchase or using a paid deliverable, you agree to the version linked or presented at checkout. If you purchase for an organization, you represent that you can bind it. Purchasers must be at least 18 years old or the age of legal majority where they live.

Viewing the public site does not grant a license to copy its renderer or visual output. Our Privacy Notice explains how information is handled. A signed commission proposal or other written agreement controls if it expressly conflicts with these terms.

2. What the algorithmic artwork is

GhostSandbox is an artist-directed, deterministic procedural system. An integer seed supplies repeatable variation to a defined renderer. The live renderer is not a generative-AI model and does not generate imagery from prompts; it is also not a blockchain asset, an NFT, or a promise of token ownership.

A casting's provenance is identified by its seed, palette, licensed domain, delivered artifact, license header, and build identifier. "Same seed" means the same authored system and parameters. Exact pixels can still vary with viewport, browser, operating system, graphics hardware, color management, accessibility settings, or a requested recasting. Preserve the delivered file and build identifier when exact provenance matters.

Exclusivity is a contractual promise not to license the same reserved casting to another customer's production site. It does not create ownership of a number, mathematical relationship, physical phenomenon, technique, or visual idea, and it does not promise that a different seed can never have aesthetic similarities.

The public foundry and its tone, cube, and vortex studies are artistic experiments. They are not scientific instruments or medical, therapeutic, investment, or safety advice. Audio starts only after intentional activation; listen at a comfortable level and stop if you feel discomfort.

3. Orders, payment, and taxes

Stripe hosts checkout and processes payment. Prices are displayed in US dollars unless checkout says otherwise. An order is accepted when Stripe confirms payment and, for custom work, we acknowledge the supplied domain or project. We may decline or refund an order we cannot lawfully or reasonably fulfill.

You are responsible for accurate contact, domain, and project information and for taxes or duties not collected at checkout. Stewardship after a Casting's first year is optional and is not automatically renewed or charged unless a later written order clearly says otherwise.

4. License grants

Captures and Field Packs

A Download or Field Pack grants the purchaser a perpetual, worldwide, non-exclusive, non-transferable license to:

• display the delivered images on devices owned or controlled by the purchaser;
• use them on the purchaser's personal, non-commercial social profile; and
• make reasonable backup copies and physical prints for personal use.

Captures are open editions. They are not Castings and include no source code, domain license, scarcity, or exclusivity.

The Casting

A completed Casting purchase grants the named purchaser a perpetual, non-transferable license to display the delivered embed on one production website at the hostname supplied at checkout. The bare domain and its www form count as the same Licensed Domain; other domains and subdomains require written permission.

After accepting the order, AdamsLocal reserves that casting seed to the Licensed Domain and will not license the same casting to another customer. The purchase includes initial palette tuning and up to three recastings requested within twelve months after delivery. A recasting adjusts the existing field; it is not a new commission or a transfer to another site.

The Commission

The Commission amount shown at checkout is a deposit that opens a written creative and technical scope. Remaining fees, schedule, deliverables, revision limits, domain coverage, attribution, portfolio use, and exclusive rights are defined before bespoke work begins. If no scope is agreed, we will refund the deposit. A commission seed is retired only as stated in the accepted scope.

Rights retained and prohibited uses

AdamsLocal retains the renderer, source code, algorithms, design system, trademarks, maker's mark, and all rights not expressly granted. A customer owns their copy of a delivered file, not the underlying intellectual property.

Unless a written agreement expressly allows it, you may not:

• resell, sublicense, redistribute, publish, or offer a deliverable as stock, source material, a template, or a downloadable asset;
• use a Capture for a business, brand, client, product, paid campaign, or other commercial purpose;
• mint or associate a deliverable with an NFT or similar token;
• use a deliverable, its output, or extracted frames to train, fine-tune, evaluate, or populate a machine-learning model or dataset;
• reverse engineer, decompile, extract, modify, or make a derivative generator from the renderer, except to the limited extent applicable law cannot prohibit;
• remove license notices, the maker's mark, build metadata, or domain controls;
• misrepresent authorship, provenance, scarcity, or license status; or
• use a deliverable unlawfully or in a way that violates another person's rights.

5. Delivery, support, and refunds

Downloads and Field Packs are delivered through an unlisted page after payment. Unlisted does not mean access-controlled: keep the link private and do not share it. Contact us within 14 days if a file is missing, corrupt, inaccessible, or materially different from its description. We will provide a working replacement or a refund.

We acknowledge Casting and Commission orders within one business day. Casting delivery begins after required domain and palette information is confirmed. Casting refunds are available before custom work is approved or delivery begins. Commission refunds follow the rule above until a written scope is accepted, then follow that scope.

Nothing in these terms limits cancellation, refund, conformity, or other consumer rights that applicable law does not allow us to waive.

6. Availability, warranties, and liability

We may improve, replace, or retire the public site and experimental studies. Delivered artifacts remain governed by the terms accepted with their order. Browser and platform changes can affect interactive software; unless a written scope says otherwise, future compatibility work is not included after the stated support or stewardship period.

Except for the express promises in an order or written scope, deliverables are provided "as is" and "as available." To the extent permitted by law, AdamsLocal disclaims implied warranties and is not liable for indirect, incidental, special, exemplary, or consequential damages. AdamsLocal's aggregate liability arising from an affected order will not exceed the amount paid for that order.

These limitations do not apply where prohibited by law or to liability that cannot lawfully be limited. California law governs these terms except where mandatory law in your place of residence applies.

7. Changes and contact

We may update these terms prospectively by changing the effective date and version on this page. The version accepted with a purchase continues to govern that order unless both parties agree otherwise in writing.
